Is income outside Poland taken into account when assigning payments
The Ministry of Family, Labor and Social Policy of Poland has published an explanation of what income of Ukrainians with UKR status is taken into account when assigning family payments and how the Polish Social Insurance Institution (ZUS) verifies recipients.
The explanation from the ministry states that the relevant Polish departments, when determining the amount of income per person in a family of Ukrainians with PESEL UKR status, do not take into account the income of a family member who, according to the applicant's declaration, does not live in Poland.
That is, Ukrainians with temporary protection in Poland will receive payments regardless of the fact that their family members in Ukraine have income.
The law stipulates that Polish authorities responsible for assigning family benefits to Ukrainian citizens cannot require Ukrainian forced migrants to provide information on the financial status of a family member who works and receives a salary or financial support in Ukraine.
Whose income is not taken into account when assigning benefits
When establishing the right to family assistance in Poland, a circle of persons whose income is taken into account is determined. The income of those who are not considered family members is not taken into account:
- a child in a marriage;
- as well as an adult child with their own child.
The income of any family member who does not live in Poland is also not taken into account.
The same requirements apply to Ukrainians with temporary protection as to Polish citizens. This means that it is necessary to provide documentary evidence of the grounds for receiving social support in Poland.
Rules for checking Ukrainians in ZUS
The Social Insurance Institution (ZUS) has additional rights to verify recipients of social benefits in Poland.
ZUS may summon a Ukrainian citizen residing in Poland to a personal meeting within 3 working days at the structural unit specified in the summons to provide explanations necessary for the correct determination and implementation of benefits or other forms of subsidies.
Also, ZUS or another competent authority has the right to leave without consideration the application of a person applying for Polish social or family benefits if the person was summoned for personal arrival, but did not arrive at a certain unit (institution) within the specified period.
On this basis, payments to Ukrainians with UKR status may be temporarily suspended.
If a Ukrainian citizen arrives at this body after the specified period, payments may be resumed from the following month, provided that the person continues to meet the conditions for receiving.
