The suspicion of the mayor of Irpen is illegal and should be canceled, - lawyers

The lawyers who took on Markushin's defense explain that the suspicion of the mayor of the city has the right to be signed only by the Prosecutor General, his deputy or the head of the regional prosecutor's office, but in this case it was signed by the acting prosecutor of Kyiv, which is a violation of the norms of the Criminal Procedure Code of Ukraine.

"The fact that the suspicion of Oleksandr Markushin was signed not by the Kyiv region prosecutor Maksym Krym, but by the acting Kyiv city prosecutor's office Maria Vdovychenko indicates signs of political persecution. According to the law on the prosecutor's office, the Kyiv city prosecutor's office is equal to the regional one, but the criminal procedure law does not give Ms. Vdovychenko the right to sign the suspicion of the head of Irpen. Clause 1 of Part 1 of Article 481 of the Criminal Procedure Code of Ukraine clearly and unambiguously states that the head of the regional prosecutor's office reports the suspicion to the mayor "within the limits of his authority." The Kyiv city prosecutor's office and its head have no authority over the mayor of Irpen - this is the area of ​​responsibility of the Kyiv regional prosecutor's office. Therefore, in fact, Oleksandr Markushin does not currently have the status of a suspect," the Miller law firm said.

The lawyers also noted that, according to Markushin, the case against him is "custom-made" and that in this way the well-known developer and former mayor of Irpen, Vladimir Karplyuk, is trying to remove the current mayor from office on the eve of a critically important session, at which deputies are to consider the issue of canceling the lease of land under the illegal construction of the residential complex "River Port" and providing registration to the illegal market on the floodplain, to which Mr. Karplyuk is related.

"By an interesting coincidence, the State Bureau of Investigation and the prosecutor's office indicate that Vladimir Karplyuk is a witness in this case, who provided evidence of the "crime" of Alexander Markushin," the lawyers reported.
