Strengthening SAP's Autonomy
The Ukrainian Parliament's recent decision to pass a legislative proposal aiming to bolster the autonomy of the Specialized Anti-Corruption Prosecutor's Office marks a pivotal moment in the country's anti-corruption efforts. With a substantial majority of 298 members of parliament supporting the bill, this move is set to redefine the operational framework of the SAP.
Key Amendments and Implications
The approved law grants the SAP a distinct legal entity status, separating it from the General Prosecutor's Office. Notably, it encompasses alterations to the competitive selection process for leadership positions, deputies, and prosecutors within the institution.
Expanded Powers and Accountability
Moreover, the legislation extends the SAP Chief's inclusion in the list of officials with access to various levels of state secrets. Empowered with the authority to independently determine the structure, staff, and operations, the head of the SAP gains considerable autonomy.
Transparent Recruitment Procedures and Financial Independence
The law outlines transparent recruitment procedures for administrative roles and prosecutors within the SAP, specifying criteria for commission members, remuneration details for the leadership and staff, as well as mechanisms for accountability and audits involving international experts. Additionally, the law envisages the establishment of the SAP apparatus and separate funding.
International Support and Extradition Powers
Crucially, international technical assistance could contribute to financing the activities of the commission members and their assistants. Notably, this legislative move aligns with recent calls by the "Group of Seven" ambassadors on December 5, urging the adoption of the bill, cancellation of the "Lozovyi amendments," and enabling the SAP to pursue extradition requests and investigations involving members of parliament.
